In this Privacy Statement, you will find more information about the processing of your Personal Data by delaware.
Delaware Consulting Malaysia Sdn. Bhd. (Company No. 201501040733 / 1166051-W) (“delaware”, “we” or “us”) considers your privacy very important. We strive to process your Personal Data in a lawful, appropriate, and transparent manner in accordance with the Personal Data Protection Act 2010 (Malaysia) (the “PDPA”) and any subsidiary legislation, regulations, or codes of practice issued under the PDPA, as well as any other applicable data protection laws. With this Privacy Statement, we want to emphasise this commitment.
Please take the time to read through this Privacy Statement to better understand the categories of your Personal Data that delaware processes. We also explain the purposes for which we process your Personal Data, the legal bases on which such processing is carried out, and to whom we may disclose or transfer this data.
This Privacy Statement also describes your rights under the PDPA, including the right to access and correct your Personal Data, to withdraw consent to certain processing activities, and to object to direct marketing. It also explains how you can exercise these rights in accordance with the applicable Data Protection Laws.

2 What is the scope of this Privacy Statement and for whom is it intended?
Delaware Consulting Malaysia Sdn. Bhd. (Company No. 201501040733 / 1166051-W) (“delaware”, “we” or “us”) considers your privacy very important. We strive to process your Personal Data in a lawful, appropriate, and transparent manner in accordance with the Personal Data Protection Act 2010 (PDPA) and any other applicable data protection legislation in Malaysia. With this Privacy Statement, we want to emphasise this commitment.
In all situations described in this Privacy Statement, delaware will process your Personal Data as a controller. This means that we determine the purposes and means of processing this Personal Data; in other words, we determine its 'how' and 'why'.
This Privacy Statement is intended for all visitors to the delaware website, all (potential) applicants and all (potential) service providers and customers of delaware.
For the purpose of this Privacy Statement, a Delaware Affiliate means any other entity that controls, is controlled by, or is under common control with delaware. For the purposes of this definition, "control" means the power, direct or indirect, to manage the affairs of an entity by virtue of participating in a shareholding of at least 40 per cent of the voting rights, participating interests or economic interests in that entity.
When you visit the sub-domain of a particular Delaware Affiliate (for example, the sub-domain of Delaware France), delaware will transfer your Personal Data to the relevant Delaware Affiliate, which will then process your Personal Data as the data controller. Such processing shall be carried out either in accordance with what is described in this Privacy Statement or, where applicable, in accordance with a separate Privacy Statement made available on the sub-domain of the Delaware Affiliate in question.
For the purposes of this Privacy Statement, the term Data Protection Law means:
The Personal Data Protection Act 2010 (Malaysia) (PDPA) and all subsidiary legislation, regulations, and codes of practice issued under it;
Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("GDPR");
The e-Privacy Directive (Directive 2002/58/EC) as amended; and
Any other applicable legislation relating to the processing of Personal Data and privacy, including amendments, modifications, or replacements thereof.
For the purposes of this Privacy Statement:
Personal Data refers to any information regarding an identified or identifiable natural person. This includes, for example, your name, photograph, telephone number, email address, bank account number, etc. Under the PDPA, Personal Data also covers both sensitive personal data (such as health information) and non-sensitive data.
Processing means any operation or set of operations relating to (a set of) Personal Data, whether or not performed by automated means, such as collecting, recording, organising, structuring, storing, updating or amending, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, blocking, erasing or destroying data.
3 When and why do we process your Personal Data?
3.1. When you visit the website
When you visit the delaware website, we collect a limited amount of Personal Data necessary for the management and operation of the website. With your consent, we also collect other Personal Data, for example to optimise the user experience on our website or for analytical and statistical purposes.

3.2. For the organisation of physical and virtual events
From time to time, delaware organises physical and virtual events, such as physical seminars or study days and online webinars, for which you can register either through a dedicated form on the website. by sending an email to events@delaware.pro or using any other registration method. As part of this, we process your Personal Data for the purpose of organising and managing the event and to be able to communicate further necessary information to you.

From time to time, delaware makes online marketing materials, including e-books, available for download from its website. 3.6 Social media
We may process Personal Data obtained through social media platforms (including Facebook, Instagram, LinkedIn and Twitter) when something is delaware-related or directed to delaware in order to (i) respond to enquiries or complaints in the first line, (ii) monitor our online reputation, (iii) integrate the testimonials about delaware and our services that you make public into our internal and external communications, and (iv) improve our products and/or services and identify opportunities for delaware to focus on.

3.7 When you apply for a job at delaware
When you submit an application to delaware, for example via the delaware website or a third party website, such as LinkedIn, for a position at delaware, your Personal Data will be processed for recruitment purposes and for the administration and management of our (future) employees.
However, if your application is unsuccessful (for example if the position has already been filled), your Personal Data will be stored by delaware for a period of twelve months thereafter. After the expiry of this period, you will receive an email asking you to choose whether you want to keep your Personal Data in the system for a longer period or have your Personal Data removed from the system. If you do not respond within 30 days, your data will automatically be anonymised in our database. This process repeats itself every year as long as you decide to stay in our database.
If your application is successful, you will receive another privacy statement.
3.7.1 Recruitment purposes
In the context of recruitment, delaware processes your Personal Data for the following recruitment purposes: recruitment, administration and management of (future) employees.

4 How is your Personal Data shared with third parties?
We only share and disclose information, including to third parties, as described in this Privacy Statement.
Your Personal Data will also be shared with governmental bodies and/or police officials when this is necessary for the purposes described above, where required by law or where necessary for the legal protection of the Controller's legitimate interests in accordance with applicable law.
5 Is your Personal Data transferred outside the EEA?
For the purposes described in this Privacy Statement, your data will generally be held within the European Economic Area ("EEA") and will only be transferred outside the EEA to a country or countries that the European Commission has recognised as providing an adequate level of data protection. If your data are transferred to, or stored in, a country outside the EEA that is not recognised as providing an adequate level of protection, delaware will take appropriate security measures to ensure that the transfer meets the requirements of the Data Protection Act.

6 How long will we keep your Personal Data?
We will retain your Personal Data for as long as necessary for the performance of the processing activities listed in this Privacy Statement, as long as you are otherwise informed or as long as permitted by applicable law.
7 What are your rights and how can you exercise them?
When delaware processes your Personal Data, the Data Protection Act grants you various rights. Barring legal exceptions, you can exercise them free of charge. These rights may be limited, for example, when complying with a request would reveal Personal Data about another person, or when you ask us to delete information we are legally obliged to retain or that we retain based on our legitimate interests. If you contact us to exercise your rights, we will respond within one month. Exceptionally, this may take longer (up to a maximum of three months in total), but we will let you know within one month. Whether or not you can exercise your rights depends on the processing and the legal basis.
We ask you to ensure that it is always clear exactly which right you wish to exercise and by what means (e.g. email, post, oral etc.) you wish to receive the information. Please note that in some cases we may need more information. We want to be sure that we are helping the right person.
Should you have any unanswered concerns, you always have the right to complain to the supervisory authority. We naturally encourage you to come to us in the first instance but, to the extent that this right applies to you, you are entitled to complain directly to the supervisory authority.
7.1 Right to access and correct your Personal Data
You have the right to access, review and rectify your Personal Data. You may be entitled to ask us for a copy of your information in order to appraise and/or change it. If you wish to correct information such as your name, email address, address and/or any other data or preferences, you can easily do so by contacting us at privacy@delaware.pro. You can also ask us for a copy of the Personal Data we process as described in this Privacy Statement.
7.2 Right to object
You may object to the processing of your Personal Data under certain circumstances described in the Data Protection Act, including when your Personal Data is processed for direct marketing purposes, as well for any potential reasons related to your specific situation when delaware processes your Personal Data based on the legitimate interests of delaware or a third party.
7.3 Right to withdraw your consent
Wherever we rely on your consent, you will be able to choose at any time and on your own initiative to withdraw such consent by contacting us at privacy@delaware.pro. The withdrawal of your consent shall not affect the lawfulness of the processing based on your consent before any such withdrawal.
7.4 Right to restrict processing
Under certain circumstances, and as described in the Data Protection Act, you may request us to restrict the processing of your Personal Data. This is the case, for example, if you are disputing the accuracy of your Personal Data. If so, we will restrict the processing until we are able to verify the accuracy of your data.
7.5 Right of deletion
In accordance with the Data Protection Act, you have the right to delete your Personal Data as processed by us, as described in this Privacy Statement, in the event that it is no longer necessary for the purposes for which the data was initially collected or processed, or in the event that you have withdrawn your consent or objected to a type of processing described in this Privacy Statement and no other grounds for processing exist. If you want your Personal Data to be deleted, you may submit a request via privacy@delaware.pro.
7.6 Right to Transferability of Personal Data
Where the processing of your Personal Data is carried out through automated processes and is based on your consent or on the performance of a contract between you and us, you have the right to receive the Personal Data processed about you in a structured, commonly usable and machine-readable form and to transfer it to another service provider.
8 Does this Privacy Statement apply to third party websites?
When you click on a link from a third-party website, you will be directed to a website over which we have no control and our Privacy Statement will no longer apply. Your browsing behaviour and interaction on any other website is subject to the terms of use and privacy and any other statements applied by the third-party websites. We recommend that you read the privacy statements of other websites carefully. Delaware is not responsible or liable for the information or content presented on third-party websites.
9 What happens if delaware changes this Privacy Statement?
Delaware reserves the right to modify and update this Privacy Statement as needed. If this involves a fundamental change to the processing or if the changes are relevant to the nature of the processing or affect you and your data protection rights, we will draw your attention to this. 2. Apakah skop Pernyataan Privasi ini dan kepada siapakah ia ditujukan?
Dalam semua keadaan yang diterangkan, delaware memproses Data Peribadi anda sebagai pengawal data. Ini bermaksud kami menentukan tujuan dan kaedah pemprosesan, iaitu “bagaimana” dan “mengapa” data diproses.

Takrif
- Data Peribadi ialah sebarang maklumat mengenai individu yang dikenal pasti atau boleh dikenal pasti, termasuk nama, gambar, nombor telefon, alamat e-mel dan nombor akaun bank. Di bawah PDPA, ia merangkumi data peribadi sensitif dan bukan sensitif.
- Pemprosesan ialah sebarang operasi berkaitan Data Peribadi, sama ada secara automatik atau tidak, termasuk mengumpul, merekod, menyusun, menstruktur, menyimpan, mengemas kini, meminda, mendapatkan semula, merujuk, menggunakan, mendedahkan, menyebarkan, menyediakan, menyelaraskan, menggabungkan, menyekat, memadam atau memusnahkan data.

3.6 Media sosial
Kami mungkin memproses Data Peribadi daripada Facebook, Instagram, LinkedIn dan Twitter apabila kandungan berkaitan atau ditujukan kepada delaware untuk menjawab pertanyaan atau aduan, memantau reputasi dalam talian, memasukkan testimoni awam dalam komunikasi, menambah baik produk atau perkhidmatan dan mengenal pasti peluang. Kandungan yang diterbitkan pada media sosial kami mungkin boleh diakses oleh orang awam. Berhati-hati apabila mendedahkan maklumat seperti kewangan atau alamat. Kami tidak bertanggungjawab terhadap tindakan pihak ketiga berhubung maklumat yang anda terbitkan.

3.7 Apabila anda memohon pekerjaan di delaware
Apabila anda memohon jawatan melalui laman web delaware atau laman pihak ketiga seperti LinkedIn, Data Peribadi diproses untuk pengambilan serta pentadbiran dan pengurusan bakal pekerja. Jika permohonan tidak berjaya, data disimpan selama 12 bulan. Selepas tempoh itu, anda akan menerima e-mel untuk memilih sama ada data dikekalkan atau dipadam. Jika anda tidak menjawab dalam 30 hari, data akan dinyahnamakan secara automatik. Proses ini berulang setiap tahun selagi anda memilih untuk kekal dalam pangkalan data. Jika permohonan berjaya, anda akan menerima pernyataan privasi lain.

Dalam konteks pengambilan, delaware turut memproses Data Peribadi untuk mematuhi kewajipan undang-undang dan kawal selia di bawah undang-undang, peraturan atau keputusan pihak berkuasa negara dan badan awam yang berwibawa.

3.8.1 Pengurusan dan pentadbiran hubungan pelanggan
delaware memproses Data Peribadi pegawai hubungan pelanggan untuk tujuan perniagaan dan pentadbiran, termasuk mengurus hubungan, mengemukakan cadangan projek, melaksanakan perjanjian atau langkah pra-kontrak, melindungi kepentingan ekonomi, memastikan pematuhan, menjalankan pelaporan dan audit, mengurus dakwaan salah laku atau penipuan, mengurus penggabungan dan pengambilalihan, menyimpan rekod dan pengebilan.

Anda boleh membantah komunikasi pemasaran secara percuma dan tanpa memberikan sebab melalui privacy@delaware.pro atau pautan nyahlanggan.

4. Bagaimanakah Data Peribadi dikongsi dengan pihak ketiga?
Kami hanya berkongsi dan mendedahkan maklumat, termasuk kepada pihak ketiga, sebagaimana diterangkan dalam Pernyataan ini. Data anda juga boleh dikongsi dengan badan kerajaan dan/atau pegawai polis apabila perlu bagi tujuan di atas, dikehendaki undang-undang atau perlu untuk melindungi kepentingan sah Pengawal Data menurut undang-undang yang terpakai.
5. Adakah Data Peribadi dipindahkan ke luar EEA?
Bagi tujuan dalam Pernyataan ini, data anda secara amnya disimpan dalam Kawasan Ekonomi Eropah (“EEA”) dan hanya dipindahkan ke luar EEA ke negara yang diiktiraf oleh Suruhanjaya Eropah sebagai menyediakan tahap perlindungan data yang mencukupi. Jika data dipindahkan atau disimpan di negara yang tidak diiktiraf sedemikian, delaware akan melaksanakan langkah keselamatan yang sesuai bagi memastikan pemindahan memenuhi keperluan undang-undang perlindungan data. 6. Berapa lamakah Data Peribadi disimpan?
Kami menyimpan Data Peribadi selama yang diperlukan untuk melaksanakan aktiviti pemprosesan yang disenaraikan, selama tempoh lain yang dimaklumkan kepada anda, atau selama yang dibenarkan oleh undang-undang terpakai.
7. Apakah hak anda dan bagaimanakah hak itu boleh dilaksanakan?
Apabila delaware memproses Data Peribadi, undang-undang perlindungan data memberikan anda pelbagai hak yang, tertakluk kepada pengecualian undang-undang, boleh dilaksanakan tanpa bayaran. Hak mungkin dihadkan jika pematuhan mendedahkan data orang lain atau jika anda meminta kami memadam maklumat yang wajib disimpan atau disimpan atas kepentingan sah. 7.2 Hak untuk membantah
Anda boleh membantah pemprosesan dalam keadaan tertentu, termasuk pemasaran langsung atau sebab berkaitan keadaan khusus anda apabila pemprosesan berasaskan kepentingan sah delaware atau pihak ketiga.
7.3 Hak untuk menarik balik persetujuan
Jika pemprosesan bergantung pada persetujuan anda, anda boleh menarik balik persetujuan pada bila-bila masa melalui privacy@delaware.pro. Penarikan balik tidak menjejaskan kesahan pemprosesan sebelum penarikan balik.
7.4 Hak untuk mengehadkan pemprosesan
Dalam keadaan tertentu, anda boleh meminta pemprosesan dihadkan, contohnya apabila mempertikaikan ketepatan data. Kami akan mengehadkan pemprosesan sehingga ketepatan dapat disahkan.
7.5 Hak pemadaman
Anda berhak meminta pemadaman apabila data tidak lagi diperlukan bagi tujuan asal, anda telah menarik balik persetujuan atau membantah pemprosesan dan tiada asas lain untuk meneruskannya. Hantar permintaan melalui privacy@delaware.pro.
7.6 Hak kebolehportaan Data Peribadi
Jika pemprosesan dijalankan secara automatik dan berasaskan persetujuan atau pelaksanaan kontrak, anda berhak menerima data dalam format berstruktur, lazim digunakan dan boleh dibaca mesin, serta memindahkannya kepada penyedia perkhidmatan lain.
8. Adakah Pernyataan ini terpakai kepada laman web pihak ketiga?
Apabila anda mengklik pautan ke laman web pihak ketiga, anda akan diarahkan ke laman yang tidak dikawal oleh kami dan Pernyataan ini tidak lagi terpakai. Tingkah laku pelayaran dan interaksi anda tertakluk kepada terma penggunaan dan pernyataan privasi pihak ketiga.
